Plainfolio Terms of Service

Plainfolio ("Plainfolio," "we," "us") is a service operated by Coalescence Properties, LLC, a Texas limited liability company. These Terms of Service ("Terms") are an agreement between you and Coalescence Properties, LLC. By creating an account or using Plainfolio at plainfolio.site or any subdomain of it (the "Service"), you agree to these Terms. If you do not agree, do not use the Service.

1. Who can use Plainfolio

You must be at least 13 years old to use Plainfolio. If you are under 18, you may only use Plainfolio with the permission of a parent or legal guardian, who agrees to these Terms on your behalf. You are responsible for keeping access to your email account secure, since that is how you log in.

2. Your content belongs to you

You keep all rights to the photos and text you upload ("Your Content"). By uploading, you give us a limited, worldwide, non exclusive, royalty free license to store, copy, resize, and display Your Content only as needed to run the Service, including showing it on your site and in link previews when your site is shared. This license ends when you delete Your Content or your account, except for copies we are required to keep by law (see section 6) and brief backup copies that are removed in the normal course of operations.

You confirm that you own Your Content or have permission to upload it, and that you have any permission needed from people who appear in it.

3. What you may not upload or do

You may not use Plainfolio to upload, display, or link to:

Child sexual abuse material of any kind, including real, drawn, edited, or computer generated imagery, or any sexualized content involving a minor. We have zero tolerance for this. See section 5.
Intimate or sexually explicit images of any person shared without their consent.
Pornographic or sexually explicit content. Non sexual artistic nudity is permitted.
Content that threatens, harasses, bullies, or incites violence against any person or group.
Content that promotes terrorism or violent extremism.
Content that infringes someone else's copyright, trademark, or other rights.
Other people's private information (such as addresses, phone numbers, or ID documents) without their consent.
Anything illegal under the laws of the United States or the State of Texas, or that promotes illegal activity.
Malware, phishing, or anything designed to deceive or harm visitors.
Content that impersonates another person or organization.

You also may not try to break, overload, scrape, or get around the limits or security of the Service, access anyone else's account, or resell the Service without our written permission.

4. How we enforce these rules

We may remove any content, or suspend or close any account, that we believe violates these Terms, at our discretion and without notice. We may review content reported to us or flagged by automated tools. We are not required to monitor all content, and we are not responsible for content uploaded by users.

5. Child safety

Plainfolio uses the Cloudflare CSAM Scanning Tool, which automatically checks images served through our site against databases of known child sexual abuse material. We also review reports from visitors.

If child sexual abuse material is detected or reported on any site:

The site is immediately taken offline and the account is locked while the matter is reviewed.
The material is reported to the National Center for Missing and Exploited Children (NCMEC), as required by federal law, and NCMEC shares reports with law enforcement.
The account, its content, and related information (such as the email address and account activity) are preserved and may be provided to law enforcement, as required or permitted by law.
Confirmed violations result in permanent termination, with no refund.

If you see anything that may exploit a child, use the "report" link on the site or email info@lubbockdesign.net. You can also report directly to NCMEC at CyberTipline.org or 1-800-843-5678.

6. Cooperation with law enforcement

We may preserve and disclose account information and content to law enforcement or other authorities when we believe in good faith that it is required by law or legal process, or necessary to protect a person from harm. We keep material reported under section 5 for as long as the law requires, even if you delete your account.

7. Copyright complaints (DMCA)

If you believe content on Plainfolio infringes your copyright, send a notice to our designated agent with: your contact information and signature; identification of the copyrighted work; the URL of the infringing material; a statement that you have a good faith belief the use is not authorized; and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner.

We will remove or disable access to material identified in a valid notice. If your content was removed and you believe it was a mistake, you may send a counter notice with the information required by 17 U.S.C. § 512(g). We terminate the accounts of repeat infringers.

8. Plans, payment, and cancellation

Free plan: free sites include up to 50 MB of photo storage and 3 photo categories.

Pro plan: $1.99 per month (plus any applicable tax) raises those limits to 10 GB of photo storage and 50 photo categories, and unlocks Pro-only layouts. If a Pro plan ends, a site using a Pro-only layout switches to a free layout until Pro is active again. Payments are processed by Stripe. Your subscription renews every month until you cancel.

Cancelling: you can cancel anytime from your dashboard. You keep paid features until the end of the month you paid for. We do not give refunds for partial months.

If payment fails: we give you a 14 day grace period. After that, your site moves to the free plan. Your photos stay online, but you cannot add more until you are back under the free limits or pay again.

Price changes: we will give at least 30 days' notice by email before a price change affects you.

9. Closing your account

You may delete your account at any time. We delete your content from the Service after deletion, except as described in sections 2 and 6. We may close accounts that violate these Terms, and we may close free accounts that have been inactive for more than 12 months after notifying you by email.

10. Changes to the Service

We may change, add, or remove features, or stop offering the Service. If we shut down Plainfolio entirely, we will give you at least 30 days' notice by email so you can download your photos.

11. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non infringement. We do not promise the Service will be uninterrupted, error free, or that your content will never be lost. Keep your own copies of your photos.

12. Limitation of liability

To the fullest extent allowed by law, Coalescence Properties, LLC and its members, managers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or $50.

13. Indemnification

You agree to defend and indemnify Coalescence Properties, LLC and its members, managers, and agents against any claims, losses, and expenses (including reasonable attorney fees) arising from Your Content, your use of the Service, or your violation of these Terms or anyone else's rights.

14. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law rules. Any dispute will be resolved in the state or federal courts located in Lubbock County, Texas, and you consent to their jurisdiction.

15. Changes to these Terms

We may update these Terms. If we make a material change, we will notify you by email or in your dashboard before it takes effect. Continuing to use Plainfolio after the change means you accept the updated Terms.
